Key aspects of the procedure for the registration of temporary structures (MAF)
In December 2012 the new procedure for the placement of temporary structures (MAF) for conducting business came into force what greatly simplifies the procedure for obtaining the permit for small architectural forms (according to the applicable legislation – temporary structures). In particular, only the fixing passport for temporary structures is necessary for its placing, whereas under the previous laws a decision from the respective local authority for the placement of MAF was considered to be the permit for its placing. Applicable law defines the following stages for obtaining the fixing passport: 1. Application to the competent authority for the possibility of placing temporary structures. If there is an intention to place a temporary structure (MAF), the applicant should contact the respective executive body of local self-government with reference to the possibility of placing temporary structures and submit the following documents: an application for the possibility of placing temporary structures; graphics, which will indicate the desired location of the temporary structures with reference to the area; details of the customer. 2. Compliance of the placement of temporary structures with building codes. Within 10 working days of receipt of the application for the possibility of placing temporary structures the respective authority for town planning and architecture determines whether the location of the specified temporary structures meets the applicable building codes. The client shall be informed about the decision within three working days. 3. Application for the fixing passport to the respective authority for town planning and architecture at the planned location of the temporary structure. To obtain a fixing passport one is to submit the following documents: an application for the registration of the respective passport; layout of temporary structures; front of building sketches of appropriate temporary structures; scheme of surrounding urban land development; specifications for engineering software. 4. Registration of the fixing passport of MAF. The fixing passport of temporary structures is registered by the authority for town planning and architecture at the location of the specified structures within ten working days from the date of filing an application and necessary documents. 5. Notification about the execution of the fixing passport. After placing the temporary structures one is to notify the appropriate executive bodies of local self-government at the location of the specified structure on the execution of the fixing passport.
